Consider/Approve Amendment to Board Policy #5.200 – Separation Practices for Tenured Teachers


Background Information:

During the Special Legislative Session, dismissal procedures for tenured teachers received an ample amount of attention from the Governor and our elected lawmakers. The statute now requires the initial hearing to be held before an impartial hearing officer. In addition, the law clarifies the Board’s discretion on appeal and this discretion is fully stated in the revised policy. Due to the recent law change, TSBA revised its sample policy by completely rewriting the dismissal portion of the policy. TSBA’s sample policy needs correction in that the first full sentence on line 35 should read, “That hearing shall be set not later than thirty (30) days following receipt of the initial request for a hearing.”  Our current policy is attached for informational purposes only.

Staff Recommendation:

I recommend approval of the amendment to Board Policy #5.200 – Separation Practices for Tenured Teachers, as set forth above on first reading.
